1. Purpose
These terms govern the use of Nakama, a companion app published by the Association WizIT, Chemin des Fourcles 13, 1985 La Forclaz VS, Switzerland.
Using Nakama means accepting them.
2. Who Nakama is for
Nakama supports people with an intellectual disability, with the help of a carer or a professional who sets up the app and remains responsible for it.
The app is set up on the device of the person being supported and under their Google account. The carer who sets it up therefore acts under that identity, and it is up to them to enter only what the person agrees to see appear in it.
3. What Nakama is not
Nakama is not a medical device. It makes no diagnosis, proposes no treatment and replaces no medical, educational or social follow-up.
Nakama is not an emergency service, nor a surveillance system. It does not guarantee that a situation of distress will be detected, or that an alert will be passed on to anyone.
E-mail alerts exist, but they are not guaranteed. When Nakama believes it detects distress or problematic use, it may send an e-mail to the designated carers. This e-mail may not be sent, or may not arrive: situation not detected, missing or incorrect address, sending service unavailable, cap of 5 e-mails sent per 10 minutes, message put in the spam folder by the recipient's mail service. Nakama must therefore never be used as a means of keeping watch or of raising an alert.
In an emergency, call the emergency services (144 in Switzerland).
4. The answers are produced by artificial intelligence
The answers come from a language model (Google Gemini, called through Vertex AI on Google Cloud). To produce them, the content of the conversation is sent to this service (see the privacy policy). They may be inaccurate, unsuitable or made up, despite the profile and the instructions that frame it.
It is up to the carer to stay attentive to how it is used, and to judge whether the app suits the person they support.
5. Access under licence
Access to Nakama is reserved for the Google accounts entered in our register. We may grant, refuse, suspend or withdraw access, in particular when a licence expires, at the request of the institution concerned, or in the event of use contrary to these terms.
A withdrawal of access generally takes effect within a minute, and within ten minutes at the latest if the register is temporarily unreachable. The data stays in the person's Google Drive: withdrawing access deletes nothing on their side.
6. Google account and storage
Nakama requires a Google account. The data produced is written to the Drive of that account, in a nakama-resources folder (see the privacy policy).
You are responsible for this account, for its security, and for the available storage space.
Withdrawing the access authorisation from your Google account stops Nakama from reading and writing in your Drive: the app can no longer synchronise until you authorise it again. Deleting the nakama-resources folder or moving it to the bin suspends saving to Drive; the device keeps working with its local copy. To erase everything, use “Reset the app” (« Réinitialiser l'application » in the app) in the settings (see the privacy policy).
7. The PIN code
Access to the settings is protected by a PIN code. This code is a safeguard against accidental mishandling, not a security measure. It does not protect the data against someone who has access to the unlocked device or to the Google account.
8. Expected use
You undertake not to use Nakama for an unlawful purpose, to harm others, to circumvent the access limitations, or to disrupt its operation.
9. Availability
Nakama is provided as is, with no guarantee of availability or of the absence of errors. The service depends on third parties (Google in particular, and the service that sends the alert e-mails) whose interruption may make it unavailable.
We may change, suspend or stop the service. If it is stopped, the data stays in each person's Drive.
10. Liability
To the extent permitted by applicable law, we cannot be held liable for indirect damage resulting from the use of Nakama, nor for the consequences of an unsuitable answer from the model, nor for the failure to detect a situation of distress.
Nothing in these terms limits a liability that cannot lawfully be limited, in particular in the event of gross negligence.
11. Applicable law
These terms are governed by Swiss law. The place of jurisdiction is the registered office of the Association WizIT, subject to any mandatory place of jurisdiction.
12. Changes
These terms may be changed. The date at the top of the page shows the latest version.
